Its Time to Fortify your Staffing Firms Cybersecurity

Its Time to Fortify your Staffing Firms CybersecurityIts Time to Fortify your Staffing Firms CybersecurityIts Time to Fortify your Staffing Firms Cybersecurity RossheimAs a staffing firm executive, all of your energies are focused on matching clients with great talent. But then the unnerving news headlines catch your eye ransomware attacks like Mays WannaCry and Junes Petya hit thousands of organizations, with direct and indirect costs often reaching six or seven figures per company.Unfortunately, most businesses, regardless of industry, are hit by one sort of cyberattack or another. Not surprisingly, the threat has increased demand for cybersecurity hiring.Where do you begin to build cybersecurity for your staffing company? And how can you enhance your existing measures against the advancing threat? Here are some guiding principles to protect your staffing company.Recognize that your staffing firm holds sensitive data. In addition to internal company data, your firms strategic aspla tzsets include confidential data on both client companies and job candidates. Bad actors may be tempted to try to steal that data and exploit it for any number of purposes. You can tell a lot about a person from their resume, says Darren Hayes, director of cybersecurity and an assistant professor at Pace University in New York. You may find their email address, Social Security number, skills set.Be aware that staffing firms are very vulnerable to a cyberattack. Sectors such as financial services and government are widely recognized as targets of cyber criminals the staffing industry not so much. This has led to woeful unpreparedness for the ever-morphing cyber threats. Its a challenge for staffing firms just to be able to track the assets they provide to staff, the information stored on laptops or phones, to make sure its secure and is retained by the staffing firm, even when workers leave the company, says Christopher Roach, national IT practice leader for CBIZ Inc.s Risk Advisory S ervices.Dont assume that your IT folks have got you covered. Your technologists have demands coming at them from every direction.Even the technical specialists responsible for security are likely spread too thin to fully comprehend and appreciate the new threats to digital organizations, says a report from trade group CompTIA.Its up to your top management to give IT the resources required to make information security a top priority. For starters, make sure backups are happening, says Roach.Dont assume your workers are acting prudently with every keystroke. Employee cybersecurityliteracy in safe practices should be a key element of your cybersecurity strategy, but its not enough.More than three-quarters of users who said they understood the risks of clicking on links in emails clicked on them anyway, according to a research summary by security vendor Barkly. Be sure employees know how to respond to suspect emails.Bring in an outside expert to assess your cybersecurity. At larger firm s with multiple offices, it makes sense to bring someone in to do a vulnerability assessment, says Roach. The best kind of security protection is help from the outside, says Hayes. Outside providers can give you betterphishing protection. Internal network people tend to think cyber threats dont apply to them.Demand proof of all of your vendors security measures. If your agency is like most, you share data with vendors and may even have given them access to some of your internal systems. Beware.Staffing firms need to vet any vendors they use for information security, says Roach. With cloud-based applications, ask for a detailed explanation of security measures before you buy.Counter your agencys potential role as a third party to a hack. Your firms liabilities for exposed data may go beyond your clients and candidates.Analyzing stolen resume data, hackers can easily learn what kinds of systems candidates were working on at previous employers, which can enable them to identify potenti al vulnerabilities at those companies, according to Roach. Attackers like to go to third parties to find vulnerabilities, he says.Keep up with emerging security threats. Last years cyber threats, and even yesterdays, may not top the list of newfangled hacks that your organization should prepare for. Witness WannaCry and other ransomware attacks of 2017. Ransomware is a threat that can really stop your business unless youre prepared to respond, says Roach.Budget for ongoing employee security training. Do your employees know what company rules say about BYOD security? Laptops brought home? Apps brought in to work? Make sure they do.A key vulnerability is the employee who doesnt know the companys acceptable use policy, says Roach. More and more companies are extending training efforts to the overall workforce, the CompTIA report says.Treat cybersecurity as an investment. Cyber threats are so numerous and varied that its not possible for any one firm to fully address them all. You can o verspend on cybersecurity, Roach says. Theres a diminishing rate of return. So we try to set a baseline, but then the company has to own it.Its wise to retain a consultant to periodically recheck the companys systems, policies and practices for vulnerabilities.

Why Work-Life Balance Doesnt Make Sense - The Muse

Why Work-Life Balance Doesnt Make Sense - The MuseWhy Work-Life Balance Doesnt Make Sense People talk about work-life balance as if achieving it is the precious key to happiness. Tips and tricks abound. But there are two big problems with this supposed golden ticket. First, the very phrase suggests that work isnt part of your life, its separate. Yet your career probably takes up a huge amount of your waking hours, so how could it leid be an integral part of your life? The second issue is that balance is elusive and rarely attainable. At its core, the act of balancing is both inflexible and delicate, but life requires flexibility. So on your quest for happiness, success, and fulfillment, theres actually another B word you should get excited about. That word is boundaries. Develop a boundary-setting practice, and youll wonder why anyone is still talking about work-life balance. Its fine to value stability, but since life isnt still, putting balance on a pedestal is problematic. Think of all the moving parts in a given week big meetings, work travel, doctors appointments, family events, internet outages, a co-worker quitting, another one getting promoted, a lost Uber driver on the way to the networking event. Life, as you know, throws curveballs- like when your boss gets feedback from the client that he needs to push a deadline up and all of a sudden your planned 6 PM departure goes out the window, and instead of going to your favorite boxing class, you work late and pass out at 2 AM. On that kind of unpredictable day, its pretty hard to feel good about the whole work-life balance thing. You can, however, feel good about boundaries, which put you in the drivers seat with the understanding that stuff happens and wont always go as planned. You can regularly reconfigure how your day and week is going to play out based on professional responsibilities and personal needs and not freak out if one day is all work and zero play. Here are three ways to ditch balance and emb race boundaries1. Set Your Boundaries Daily Based on Your PrioritiesThe amount of time or effort youre willing to put into a work day, planning a friends engagement party, or blogging will change based on what each day looks like. If your boyfriends 30th birthday involves you pulling off a surprise party with all his friends, youre probably not going to volunteer for a time-sensitive work project. If youre in the middle of putting together a conference, youre probably not going to double your volunteer hours. When you learn to set boundaries based on your various priorities and obligations, youll feel in control and at liberty to make decisions that work for you and the kind of life you want to lead- not the kind of life youre supposed to lead. 2. Practice Establishing Your Boundaries With OthersLet people know what youre up to. Tell your colleagues and friends why youre doing away with the idea of work-life balance and explain how your boundaries mean you cant meet for happy hour a s frequently as you used to. Up for a promotion? Speak to your significant other about working a few late nights while the higher ups are making a decision on your advancement. By sharing some details of your boundary practice with the people in your life, you give them an opportunity to support your goals instead of constantly tempting you with invitations that threaten to step on the lines youve drawn. 3. Understand Your Boundaries by Failing FirstSometimes you have to slip up to learn about your boundaries redefining them is a part of the process. Pushing yourself too hard, or underestimating how long something takes will help you draw better, clearer lines in the future. Lets say youre having a relatively busy week at work, but its important for you to make time for friends and get in a long bike ride. Even though you think the way youve planned it makes sense, you end up sacrificing sleep, which leads to a longer day at the office because youre unfocused and easily distracted. That leads to bailing on dinner and drinks. Dont stress over the change of plans- just know that next week, youll tweak your boundaries. Correctly identifying what you need under the circumstances to comfortably achieve your goals takes some time.So go ahead and give yourself permission to set balance aside and instead start drawing some lines. Each week will look a little different, and not all of the lines are going to be straight. Youll be surprised at how much control and comfort you find when you stop trying to achieve the impossible work-life balance. Photo of man on phone courtesy of Caiaimage/Sam Edwards/Getty Images.

Employee Pay for Snow Days, Rain Days, and Emergencies

Employee Pay for Snow Days, Rain Days, and EmergenciesEmployee Pay for Snow Days, Rain Days, and EmergenciesWhen a snow day or other emergency impacts whether your employees work or notlage, youll need to consider the legal aspects as well as how your employees will feel about your decision when deciding to pay them. If you decide not to pay, will you harm employee moraleand whether employees will view you as an employer of choice? Employee pay depends on several factors, including whether the employee is exempt or nonexempt, state and federal laws, your employers policies, and whether the decision to close was voluntary. The Fair Labor Standards Act (FLSA), managed by the U.S. Department of Labors (DOL) Wage and Hour Division, governs the legal issues at the federal level. States may have additional rules, so check with your state department of labor or an employment law attorney. Exempt Employees According to the DOL, if you close because of inclement weather such as rain, snow , or other emergencies and the employee has worked that week, that person must be paid their full, normal salary. You may not take deductions from exempt employees pay for absences you caused or that were caused by the operating requirements of the business if the employee is willing and able to work. If the weather is worsening and state or local officials have declared a state of emergency, and you decide to close part way through a day, you must pay exempt employees their full salary. Even if no emergency was declared and you close out of concern for your employees, you may not dock pay. If an exempt employee chooses to take time off during a rainy day, snow day, or another emergency, and your business is open, you may require that the employee use vacation time, paid time off, or other accrued paid leave. If the exempt employee is not yet eligible to use accrued paid leave, you may take a salary deduction for a whole day of work missed. Another option is to ask employees to work from home if they feel unsafe coming into work. If the employee does work from home, you should not require the use of paid time off. Due to inclement weather, schools, daycare providers, and other services also close. A parent who is unable to work from home should use paid time off. Working at home involves an element of trust, although managers used to supervising teleworking employees are likely less concerned about whether an employee is working. A teleworking policy that covers employee availability, communication, and more is helpful for employees and managers. Nonexempt Employees The DOL rules are different for nonexempt, or hourly, employees. Generally, if a nonexempt employee does not come to work for whatever reason, you do not need to pay him. If you close the business for a day due to rain, snow, or another emergency, you do not have to pay nonexempt employees. Remember, however, that employees are missing work for reasons out of their control. Consider paying empl oyees for the day or part of the day. This gesture cements relationships and effectively communicates that you are committed to your employees well-being. However, if you close the company part way through a day, you do have to pay nonexempt employees for hours worked. In some states, an employer must pay employees a minimum number of hours if they have reported for work. Know the laws that govern the jurisdiction in which your company is located. Employee Policy for Snow Days, Rain Days, and Emergencies Employers need to develop a policy about how they will handle employee work hours and pay in the event of a rain day, snow day, or other emergencies. The inclement weather policy should cover What constitutes an inclement weather dayPay for employeesHow work responsibilities will be coveredHow employees will be contactedGuidelines for what the employee needs to do when she cannot make it to work because of weather An inclement weather or other emergency policy not only let emplo yees know what to expect when inclement weather or other emergencies occur, but it gives managers guidance in making the call about closing for inclement weather. haftungsausschlussPlease note that the information provided, while authoritative, is not guaranteed for accuracy and legality. 8 Key Tips to Nailing a Phone or Video Interview

8 Key Tips to Nailing a Phone or Video Interview 8 Key Tips to Nailing a Phone or Video Interview Your palms sweat. Your mouth feels dry. You feel a bit shaky. No, you’re not going on a first date; you’re just going on a job interview. But yes, sometimes those two things can feel the same! Job interviews can trip up even the most confident job seekers. That’s why you should always practice before an interview so that you build the necessary confidence to crush it. That said, there are some similarities and definite differences when it comes to phone or video interviews (and if you’re applying for a remote job, chances are you might have to do a video interview). So take your best interview suit out of storage, and sit down to read these key tips to nailing a phone interview, a video interview, or both! Here are some tips for preparing for a phone or video interview: 1. Keep it quiet. Imagine sitting down to talk to a potential employer- and the doorbell suddenly rings. This sets off your Schnauzer, who starts barking like crazy. Which then wakes up your snoozing baby, as you stumble down the hallway to quiet them both (read: Robert Kelly BBC interview). To prep for a job interview, make sure to put your pets away, and if you have small children at home, hire a sitter or have a friend come take them out for a little bit so you can conduct your interview in peace and quiet. 2. Prioritize your paperwork. There’s nothing worse than shuffling through a pile of papers on your desk to use as reference for your job interview. If you’re doing a video interview, it could make you look sloppy, and if you’re doing a phone interview, well, the sound of rustling papers can be annoying. All you really need in terms of paperwork is your resume, the job listing, and some talking points or possible questions you might have for the employer. Three pieces of paper. That’s it. 3. Take a breather. During any kind of interview, it’s easy to feel awkward if there are pauses between questions and answers. So be prepared to wait a second or two for your interviewer to ask you another question, or when you feel that you’ve answered a question accurately, take a moment for your interviewer to process what you’ve said and give him time to comment. 4. Remember to smile. Even if you’re doing a phone interview and your interviewer won’t see you, that doesn’t mean you shouldn’t smile. Smiling as you speak can actually affect your tone and create a more uplifting inflection in your voice. It can actually make you feel more positive and friendly! 5. Write it down. Let’s say that your interviewer gives you a great piece of advice or a contact name and number for you to follow up with. But where’s your pen? Ahhh, here’s one! Ack, no ink! Instead of scrambling for a writing tool (or worse, trying to remember the information), make sure to have a pen that works right next to you to jot down any information that your interviewer gives you (like future colleagues’ names or email addresses), or to take a note in case you’re afraid you might forget it après interview. 6. Test your tech. Before any interview, you should always make sure that your equipment is functioning. If you’re doing a phone interview, check your phone to see if you’re in a possible dead zone, and if you’re going to have a video interview, check your Internet connection to make sure it’s fast and furious. Ensure that you can easily access your Skype or whatever videoconferencing tool you’re using to connect with your interviewer. You can always do a test run with a friend to make sure your settings (like your mic and camera) are all working. 7. Clean it up. Clutter is a productivity killer, but it can also ruin your chances with a potential employer, too. Why? If an employer sees a messy desk, he might think that it’s a reflection of your work ethic and that your work will be subpar, too. So before the interview, organize your home office. Clear off your desk of all the clutter, coffee cups, and the plethora of personal items. You don’t have to make over your office into a minimalist’s dream, but it should look professional and clean. 8. Sit up straight. Your mother told you a million times to sit up straight and never to slouch, and here’s the reason why: if you possess good posture, it can help you look more confident and believable. You should pay attention to your posture whether you’re doing a phone or video interview, since it can affect how you speak. And if you’re doing a video interview, try to make as much eye contact with the camera as possible, and not your screen. Doing interviews is an important part of the job hiring process. Ace yours by practicing these tips, and you’ll be prepared for any video or phone interview! Looking for more job interview advice? Check out our job interviewing tips category!

2019 Military Reserve Warrant Officer Drill Pay Charts

2019 Military Reserve Warrant Officer Drill Pay Charts 2019 Military Reserve Warrant Officer Drill Pay Charts Base pay for members of the military is the same across all service branches and is based on rank and time in service, with pay raises according to years of creditable service. There are two distinct career paths in the military: Commissioned Officers and Enlisted. The pay scales for each reflect their degrees of responsibility.  Military pay  is subject to income taxes unless it is earned in a designated  combat zone. Each military service has its own names for the various enlisted ranks (Navy and Coast Guard are the same). Most enlisted members enter the military at the lowest pay grade (E-1) and climb the pay scale to higher positions with greater pay. Enlisted pay grades range from E-1 through E-9, with E representing enlisted. To gain the pay advantages of a commissioned officer, some enter the military with a higher education degree and begin their military careers through one of the officer candidate schools; some are high school graduates who attend a service academy or a civilian college while participating in a Reserve Officer Training Corps  (ROTC) program. In addition to pay, the military sometimes provides certain allowances for things such as clothing Allowance  and  for housing and cost of living, depending on circumstances.2019  Military Reserve Warrant Officer Drill Pay ChartWhile active duty  members receive full-time pay, guard and  reserve members (who are not on  active duty) rec eive part-time pay, or drill pay, depending on the number of drills they perform each month. These  basic pay charts  are for Reserve Warrant Officers of the  United States Army, Navy, Marines,  Air Force, Coast Guard and National Guard for the calendar year 2019, beginning January 1st as approved. How to Answer Interview Questions About Handling a Problem

How to Answer Interview Questions About Handling a Problem How to Answer Interview Questions About Handling a Problem Companies are always looking to hire employees who can solve problems. Thats why interviewers often ask candidates about how they have handled challenges in the workplace. Also, questions like Describe a problem you encountered at your last job are a way for interviewers to assess your attitude towards past supervisors/employers and to see if you place blame or take responsibility. How to Answer Interview Questions About Handling Problems   When questions of this type are asked, it is best to think of them as a request to share how you have intervened to solve problems in the past, rather than an opportunity to complain about difficult situations at work. Have Examples Ready to Share Prepare examples of how you have addressed problems or met challenges for each job, internship, volunteer, and leadership role included on your resume. Choose problem situations where your involvement led to a solution and avoid unsolvable or difficult issues that couldnt be improved or fixed.   Remember, employers will be listening to your answer to find out how you resolve issues, deal with conflict, and take the initiative in identifying and resolving problems. Look for examples that showcase abilities that will come in handy in the position youre interviewing for. As with resumes, numbers can be impressive: if you drove sales, reduced time, or had a result that can be quantified by metrics, be sure to share the details. Describe the Problem, Your Actions, and the Results For each example, describe the situation with just enough detail to represent the magnitude and nature of the problem. Then state how you specifically assessed the situation and acted to meet the challenge. Emphasize the skills or qualities you tapped to intervene. Include the skills which qualify you for the job. Finally, describe the results which you helped generate or how the situation was improved. Your stories dont need to represent monumental achievements; small successes which illustrate your key strengths are sufficient. Avoid rambling, and also make sure not to speak negatively about co-workers or managers. You might, for example, share a story like During my first year after an HR manager at ABC company I noticed that new recruits were leaving at a higher rate than I had experienced at previous employers. I decided to create a survey to identify the reasons for turnover. I found that they werent satisfied with the level of feedback and mentoring which they were receiving. I established protocols for managers to meet at regular intervals with new employees during the first year and set up a mentoring program. During my second year turnover of new recruits was reduced by 30% and surveys indicated a higher level of job satisfaction. Tips for Answering This Question As you are thinking through how you would answer this question, use these tips to help you formulate a strong answer. Practice storytelling: Avoid a long pause and a rambling, unfocused story by rehearsing answers. Have a sense of some of your big accomplishments from each position so that you can provide a coherent, relevant story. Remember: employers will be interested in seeing how you think and problem-solve.Choose a good example: This is a situation where a generic answer, such as, I always respond to problems quickly and efficiently doesnt suit. Choose examples that will put your relevant skills on display. Avoid pointing fingers or placing blame, and keep language neutral when describing the cause of the problem. Make sure to emphasize results: ?Be specific about what you accomplished. If you can include numbers, such as, This increased sales 10% year-over-year or, This lowered overtime costs by $1,000 a month, be sure to mention them. Tips for Answering When You Dont Have Work Experience If you do not have work experience, its okay to use examples from school. Just try to keep it meaningful and highlight your resourcefulness.  When answering the question, illustrate the example. Explain the situation and its importance, what went wrong, what impact the problem could have, what you did to fix it, and the ultimate results. Sample AnswerA good example would be, I had a major paper due for my biology class. It was an extensive research project and accounted for a big part of my grade. I was almost finished and was just writing the conclusion when a thunderstorm hit and the power went out. My professor has a strict lateness policy and accepts no excuses, so I knew I had to hand it in the next morning on time or Id fail the assignment. I used my phone to look up coffee shops that were open all night and that had wireless internet. I did back up my work frequently, so I only lost about a page and a half. I was able to go to the coffee shop, rewrite the sections of the paper I lost, add in my sources and proofread it. I handed it in the next morning on time, and ended up getting an A on the paper and in the class. In this example, the candidate shows that he is prepared; he regularly backs up his work, so that shows he is careful and conscientious. When the power went out, he thought to look up area locations where he could work, demonstrating quick thinking and resourcefulness when faced with a problem. He found a way to get the work done and met the deadline, without sacrificing quality. Thats an outstanding example that shows youre a good employee.

The Top Applicant Tracking Systems Used by Hiring Companies

The Top Applicant Tracking Systems Used by Hiring Companies The Top Applicant Tracking Systems Used by Hiring Companies For thousands of people stumped by their lack of job search success,  learning about applicant tracking systems is a major Aha! moment. But even after recognizing that theyre slipping through the cracks of these deeply flawed software, it can be tough to do battle against such a vague, nebulous obstacle. So lets add some context and call these applicant tracking systems out by name. Heres a rundown of the top applicant tracking systems youre likely to encounter in your job search. Read more: What is an applicant tracking system? Top Applicant Tracking Systems by the Numbers Ongig  runs an annual poll to determine the top applicant tracking systems. In their latest poll, they checked in with 4,218 hiring companies. Below are their top 10 applicant tracking systems compared to the top applicant tracking systems entered by real job seekers into their Jobscan Match Reports as well as our proprietary research into Fortune 500 companies. Note: Some large corporations utilize multiple applicant tracking systems. For instance, they could use one system for their corporate hiring and another system for their retail locations. Below is a closer look at three of these top applicant tracking systems. Taleo Read More: The Taleo features recruiters use to rank, filter, and reject your resume. Taleo by Oracle  can trace its development back to the 1990s and leads both lists of top applicant tracking systems. According to Ongigs research, they dominate all applicant tracking systems with a 19.1% market share, although theyve lost some ground since last year. Taleos customers include big time corporations that range from groundbreaking tech to retail to healthcare: Tesla, Starbucks, Deloitte, Nike, Kaiser Permanente, Johnson Johnson, and thousands more. Job Seeker Tip: Sometimes you can tell that youre applying through Taleo based on the URL of the job application. Wherever you find the job listing, by the time you get to the application youll probably have been redirected to a site with taleo.net in the URL. For example: Tesla (chj.tbe.taleo.net/), Starbucks (starbucks.taleo.net/), and Nike (nike.taleo.net/). Once you know, check out  these additional Taleo tips. Greenhouse Greenhouse is relatively new to the applicant tracking system market compared to some of the other heavy-hitters on this list. They got started in 2012 and have been gobbling up market share in recent years, surging to Ongigs number two spot after being fifth a year ago. Read More: Greenhouse ATS features you need to know about to create a highly visible application. Greenhouse is far and away the fastest-growing applicant tracking system within Ongigs sample, having attracted clients like Major League Baseball (from Taleo), Taco Bell (from Brassring), and Roku (from Jobvite) in the past year.  One reason for Greenhouses rise could be the foothold its gaining in the tech industry, with high profile clients such as Airbnb, Snapchat, Instacart, Pinterest, Fitbit, and many more. Job Seeker Tip:  When a recruiter  searches for a keyword, Greenhouse ATS searches applicants’ entire resumes for the keyword. One of the top factors for how the results are ranked is keyword frequency. For example, if a recruiter searches for “administrative assistant,” an applicant with five mentions of that title in their resume will appear higher in the results than someone with only two mentions. Because of this, it’s important to ensure that the most important hard skills and keywords for a job are mentioned in your resume multiple times. iCIMS Like Taleo, iCIMS  has been around since the early days of the online job search, having been founded in 1999. Based on Ongigs year-over-year research, iCIMS appears to be growing, leapfrogging Jobvite and earning a 7.4% market share. iCIMS is a highly customizable applicant tracking system with a deep feature set, meaning any two companies could be using it very differently. Their diverse client list includes big names like Amazon, Uber, Goldman Sachs, Samsung, and Southwest Airlines. Job Seeker Tip:  When a recruiter or hiring manager performs a search in iCIMS, candidates are sorted by a match percentage. One of the factors that contributes to a high ranking is keyword frequency. For example, in a search for the term accounting, a candidate that has the exact word in their resume 5 times is likely to rank higher than a candidate with only 3 mentions. Job seekers should layer in as many mentions of the most important keywords as possible without blatantly keyword stuffing. If youre not sure which words to prioritize, paste the job description and your resume below to receive an instant keyword analysis from Jobscan.   Read additional job seeker tips for iCIMS here. What if They Want Me to Sign a Non-Compete Agreement

What if They Want Me to Sign a Non-Compete Agreement What if They Want Me to Sign a Non-Compete Agreement Don’t sign that non-compete agreement.A non-compete agreement may look harmless enough, but if you’re not careful it can cost you a lot of time and money in the long run. Here’s an example: A college student had an internship at an ad agency. She signed a routine non-compete and was subsequently hired as a full-time employee. Two years later a former client of the agency offered her a great job. The non-compete from her internship still blocked her move.Sometimes you hear it said that non-compete agreements are not enforceable. Don’t believe it. They usually are. Besides, even if you’d prevail in court - who wants to go to court? It would result in a Pyrrhic victory at best.Non-compete agreements steal your future negotiating power. They typically provide no extra compensation for signing. Sometimes, they make economic sense and provide needed protection to the employer; other times they are capricious. Either way, they don’t add value to you. If presented with a non-comp ete agreement, here are some options you have from best to worst.Best: Don’t sign. Even if it makes complete sense and seems harmless, there’s just no advantage to you, so don’t sign it. Delay a little by asking to have it reviewed by a lawyer. If they still come after you for it, talk with your boss and say, “The economics of the job market are this: I give you good work and value for what you pay me, and you don’t fire me; on the other hand, you pay me well enough and treat me well enough and I don’t quit. A non-compete takes away those incentives. I believe those economic principles are powerful enough to keep both of us on our toes. I’d rather not weaken that balance. What do we need to do to let this pass?”If that doesn’t work…Better: Negotiate compensation for it. If you’re not allowed to work for or solicit clients for one year after you terminate, then how about getting 12 month’s severance or some other compensation upfront or at the time of terminat ion?If that doesn’t work…Good: Try any or all of these eight moves: Go over it with a lawyer and limit the scope of the agreement as much as possible. Have it apply to named companies and products. Define precisely the future companies and individuals that are off limits and make sure everything else is fair game. Reduce the time parameters of agreement. Get rid of any ‘would cause irreparable damage…’ phrase that leaves the consequences of violating it open-ended. Be very specific about the consequences of violating it. Limit effect to voluntary termination - so if they fire you, then the non-compete is not applicable. Have it automatically expire on the first anniversary of your hire. Have violation decided by binding arbitration, not the courts. Have 30-day written notice provisions entered into the agreement with a grace period for remedy so it can’t be slapped on you at whim. Delay its initial date of effectiveness. That way you get a chance to make sure you’re going to stick with this new company lest you work one month, leave and are trapped. If you’re absolutely, positively stuck and need a last resort…Risky, but still OK: You can try the bureaucratic defense. That’s where you create your own “red tape.” Each step of the process will take a long time. Have your lawyer add clauses the corporate counsel must review every change in language. You can string it out as long as possible, hoping it will simply get lost in the shuffle. And then there’s what not to do…Not recommended: Anything sneaky or devious. You might feel like resorting to deception, but the law of karma tenders few exemptions and you’ll reap what you sow. If discovered, or even suspected, things might get worse: You might not only find the non-compete enforced, but you may be penalized for your miscreant behavior. Instead, negotiate straight up the best you can.

Why Business Acumen Counts for Every Employee

Why Business Acumen Counts for Every Employee Why Business Acumen Counts for Every Employee Why Business Acumen Counts for Every Employee March 16, 2012 Blaszczyk, Managing Editor, Resource Center Are your employees business savvy? Do they have the business acumen to understand cash flow, net profit margin and PL and their impact on the companys bottom line? Having a clear understanding of how business works enables employees to be more productive and engaged, argues Kevin Cope, author of Seeing the Big Picture (Greenleaf, 2012.) In this interview, Cope outlines the five key drivers of business and why business performance measurements should be shared and explained with all employees from the stock boy to the business owner. Monster: Your book, Seeing the Big Picture, advocates that everyone within a company, fromtop to bottom, have the business acumen to understand how business works. Kevin Cope: Im a big believer that real success happens when employees consistently make smart decisions, work more efficiently, and really try and see the big picture without losing sight of the details. Monster: Do younger employees more often lack business acumen? Kevin Cope: A decade ago, when I founded Acumen Learning and started training people on business acumen, I thought our target audience would be front-line and younger employees, because I assumed everyone else understood business fundamentals. What our research has found is that you can go well into the middle ranks, and sometimes the senior ranks of organizations and find individuals who struggle to speak the language of business and if they do speak it fluently they often talk over peoples heads. Our work with some of the worlds most profitable companies, including 16 of the Fortune 50, has taught us that companies are becoming silos of functionally brilliant people, say in HR, IT, sales, marketing, operations, etc. But this highly-specialized workforce perpetuates a real problem offices and cubicles full of smart people who are not necessarily smart businesspeople. Monster: What impact can a lack of business acumen have on smaller companies or start ups who utilize Gen Y talent? Kevin Cope: Our up-and-coming workforce wants to be engaged. They want to feel like they are making a difference. Gen Yers want to feel like theyre part of something bigger and when theyre valued for their individual contributions they thrive. So you really need to help them see the big picture (the purpose) and clearly understand how they are making a difference. The mantra for a lot of start-ups these days could be, Its not what we make, its what we make possible. Which isnt bad, but you have to make a profit in order to make anything possible. So companies today, both large and small, have to get clear on what their mission is and then hire and develop people who make smart, fast, and profitable decisions that propel the mission forward. Monster: What financial information should all employees know? Kevin Cope: I would advise leaders to do three things: 1) Identify 5-7 key business performance measures that reflect performance. These include cash flow, net profit margin, revenue growth year over year, customer satisfaction, new store openings, etc. Even a privately held company can find a measurement that can be shared with employees. 2) Teach your employees why these measures are important and what impacts them. And dont assume employees know what the measures mean give lots of explanations and examples. 3) Regularly share results and trends on these numbers. Be sure everyone has line of sight as to how they are progressing and improving. Provide ideas and direction on how employees can improve results. Monster: How can this knowledge benefit a companys profits and bottom line? Kevin Cope: When people are brought into the companys missionand they understand how their actions impact the bottom line, they are more likely to do the right things. One key principle here is measurement. Measurement brings focus and awareness, which brings action and improvement. In our business acumen training we share the example of UPSs efforts to track CO2 emissions and gasoline usage. They figured out how to reduce the number of left hand turns on delivery routes, which takes more engine idle time.As a result UPS has saved 10 million gallons of fuel (a great impact to the bottom line) and has eliminated thousands of tons of CO2 emissions (a great purpose). Monster: Can you share any examples of smaller companies that do this well? Kevin Cope: The CEO of A Small Orange,a hosting company out of North Carolina, explained how hes tempted to split up their support costs between marketing and operating expenses. When we provide great service (which we try to do as frequently as possible), our customers notice and appreciate that. A lot of times it results in them telling their friends and social networks about us, which leads to more sales and greater customer loyalty. So heres a company that values and measures customer service not so much as a cost center, but rather as a potential profit center. Remember that measurement brings focus and attention, which leads to awareness and improvement. As a result, the company is profitable and growing. Monster: What are the five key drivers of business? Kevin Cope: The 5 business drivers are: Cash Profit Assets Growth People The first three are based on a companys three financial statements, the statement of cash flows, the PL, and the balance sheet. Growth is what investors, employees and customers expect and it doesnt happen without the last driver People. Weve taught this model to over 80,000 people in more than 30 countries. Monster: Why put people at the center of these five key drivers? Kevin Cope: We teach that the people driver refers to both the employees and the customers they serve.Acompanys ability to impact the other 4 business drivers all hinges on great employees anticipating the needs of their customers. While companies can copy your strategy and even your product to some degree, people are the one unique element that is nearly impossible to mimic. For example, while other airlines have tried to copy the strategy of Southwest Airlines, they cant duplicate its corporate culture, which in the end is one of Southwest Airlines key competitive advantages. Monster: Are people commodities? Kevin Cope: People are not commodities. Great companies like Zappos recognize that a company culturethat comes from putting people in the center of their business, instead of some other economic driver, is a real competitive advantage with real economic benefits. As CEO Tony Hsieh says, We are just a service company that happens to sell shoes. Author Bio: KevinCope is President and CEO of Acumen Learning. He is a trusted resource and confidant to business leaders from around the world and a sought-after keynote speaker. For over twenty-five years, Kevin has promoted the idea that the brightest minds in business understand the essence of how a company makes money, and they use this knowledge to drive their decisions.
